Cuba Memorial Hospital is committed to treating every patient, resident, visitor, and staff member with dignity and respect. We comply with all applicable federal, state, and local civil rights laws to ensure everyone has equal access to our services—free from discrimination, harassment, or abuse.

1. Purpose
This Notice affirms Cuba Memorial Hospital’s commitment to providing equitable access to care and services without discrimination and outlines your rights and our obligations under federal and New York State civil rights laws.
2. Scope
This policy applies to all patients, residents, visitors, applicants, volunteers, and employees interacting with Cuba Memorial Hospital facilities, programs, and services, including clinical, administrative, and long-term care settings.
3. Non-Discrimination Policy
Cuba Memorial Hospital complies with all applicable federal, New York State, and local civil rights laws, including but not limited to:
- Section 1557 of the Affordable Care Act (ACA)
- Title VI of the Civil Rights Act of 1964
- Title IX of the Education Amendments of 1972
- Section 504 of the Rehabilitation Act of 1973
- Americans with Disabilities Act (ADA)
- New York State Human Rights Law (NYSHRL)
We do not discriminate, exclude, or treat people differently based on:
- Race, color, national origin, age, disability, or religion/creed
- Sex (including pregnancy, sexual orientation, gender identity or expression)
- Marital status, military status, domestic violence victim status, familial status, HIV status
- Any other category protected by law
We also prohibit discrimination, bullying, abuse, harassment, or differential treatment based on actual or perceived sexual orientation, gender identity or expression, or HIV status, as well as discrimination based on association with another individual in any of these categories.
If you believe you have been discriminated against, you may file a complaint with the New York State Long-Term Care Ombudsman Program at (855) 582-6769 or through the grievance and external reporting options listed in Section 7.
4. Language Access & Auxiliary Aids (Free of Charge)
To ensure equal access, we provide at no cost:
- Qualified interpreters and translation of vital documents
- Auxiliary aids and services for individuals with disabilities (e.g., TTY, assistive listening devices, qualified sign language interpreters, accessible formats)
- Request assistance at registration, from any staff member, or through the Civil Rights Coordinator (see Section 7).
5. Reasonable Modifications & Accessibility
We will make reasonable modifications to policies and practices when necessary to avoid discrimination based on disability, unless such modifications fundamentally alter the nature of a service or impose an undue burden.
Our facilities and digital services are designed to be accessible in accordance with ADA/Section 504 standards and applicable web accessibility guidelines.
6. Anti‑Retaliation
Cuba Memorial Hospital prohibits retaliation against any person who, in good faith, asserts their rights, files a grievance or complaint, or participates in an investigation under this Notice.
7. How to File a Grievance with Cuba Memorial Hospital
You may file a grievance if you believe you have been discriminated against.
We will review, investigate, and respond promptly.
